h. We assume no liability for any content posted by you or any third party on our website. However, any content you submit using open communication tools on our site—provided it does not infringe third-party rights—becomes the property of Surkon Real Estate, granting us a perpetual, irrevocable, worldwide, royalty-free, exclusive license to reproduce, modify, adapt, translate, publish, display, and/or distribute it at our discretion. This applies only to content shared through open communication tools, not registration or access-related information.
i. You agree to indemnify and hold Surkon Real Estate and its parent and affiliates, directors, officers, employees, donors, agents, and licensees harmless from any loss, expense, damage, and costs, including reasonable attorneys’ fees, resulting from any violation of this User Agreement or failure to fulfill obligations related to your account by you or another user. We reserve the right to assume exclusive defense in such matters and expect your cooperation as reasonably requested.
Limitation of Warranty
By using our website, you understand and agree that all resources we provide are “as is” and “as available.” This means that we do not represent or warrant that:
i) use of our resources will meet your needs or requirements;
ii) use of our resources will be uninterrupted, timely, secure, or error-free;
iii) information obtained through our resources will be accurate or reliable;
iv) any defects in the functionality of any provided resources will be repaired or corrected.
Furthermore, you understand and agree that:

Limitation of Liability

Surkon Real Estate will not be liable for any direct, indirect, incidental, consequential, or exemplary damages arising from the use or inability to use our resources, loss of data, or system downtime, to the maximum extent permitted by law.
Copyrights / Trademarks
All content and materials available on www.surkon.pl, including text, graphics, page names, code, images, and logos, are the intellectual property of Surkon Real Estate and protected under applicable copyright and trademark law. Any inappropriate use, including but not limited to reproduction, distribution, display, or transmission, is strictly prohibited unless authorized by Surkon Real Estate.
Termination of Use
You agree that we may, at our sole discretion, suspend or terminate your access to all or part of our website and resources, with or without notice, for any reason, including breach of this User Agreement. Any suspected illegal, fraudulent, or abusive activity may be grounds for termination and may be reported to law enforcement. Upon suspension or termination, your right to use resources ceases immediately, and we reserve the right to remove any account or information you may have stored with us.
Governing Law
This website and the purchase of products or services through it are governed by the laws of our jurisdiction, excluding conflicts of law and the United Nations Convention on Contracts for the International Sale of Goods. Any legal action related to this agreement shall be brought before federal or state courts, and you consent to personal jurisdiction and waive objections to venue.
